March 20, 2020 Federal funding as compensation for private-property costs imposed by governmentally-imposed shutdowns of otherwise lawful and constitutionally protected commerce, freedom to work, freedom to travel and freedom of assembly is NOT even remotely a "bailout." Rather, it's compensation by the federal government for economic damages imposed upon private rights (of which private property is a species) to protect public safety and national security. It's akin to the Fifth Amendment constitutional prohibition against the "taking" of private property (which includes prohibition of income from otherwise lawful and constitutionally protected rights to work) for public "use" because prohibition of otherwise lawful and constitutionally protected commerce, freedom to work, freedom to travel and freedom of assembly is the virtual equivalent of confiscation of same for the public "use" of protecting public safety and national security. --Jim Wrenn, Editor, WrennCom.Com |
